What Does A Tax Attorney Do?

If you find yourself in hot water with the IRS, you may not want to handle it yourself. You may want to get a tax attorney, instead.

Tax law can be a little difficult to wrap your head around, so the services of someone from a law firm (who spent many years in law school) – will be much better equipped to handle any tax liability you may be facing.

What Is A Tax Attorney?

While you may have heard of a certified public accountant (or CPA), a tax attorney is completely different. Taxpayers may need the services of either tax professional, depending on what situation they’re in – but a tax attorney has passed a state bar exam.

This means that they have law degrees, which makes them most qualified to deal with any legal issues you may have run into. If you’re facing a tax liability (like thousands owed in back taxes, liens, or a tax levy) – a tax lawyer is a much better choice.

If you need legal help – do not go with a tax preparer. Of course, there are multiple types of tax attorneys around, so choosing the right kind is crucial.

The most valuable asset a tax attorney has, is years of experience in dealing with the IRS, as well as knowing all of the ins and outs of tax law. They are a valuable teammate in dealing with the IRS, especially in tricky tax situations.

What Does A Tax Attorney Do?

A tax attorney acts as a liaison from to the IRS. They can represent you in any tax matter you may find yourself in.

Whether it’s back taxes, a tax lien, a tax levy, or another tax problem – a tax attorney will always operate in your best interest. If you need help in preparing your taxes, however, a CPA may be a better choice.

What Kind Of Cases Does A Tax Attorney Handle?

Tax attorneys handle the thorniest of legal issues with the IRS. The cases they handle include, but are not limited to, those listed below.

  • undoing property liens and account levies
  • helping with unfiled returns
  • halting wage garnishment
  • settling back taxes
  • making compromises with the IRS

What’s The Difference Between A Tax Attorney And A CPA?

A CPA (or certified public accountant) is great for preparing your taxes, but they will not be much help when you are facing tax fraud charges, or other legal matters. A CPA will likely be great when it comes to tax planning, but they do not have law degrees like tax attorneys do.

A CPA will not practice law, whereas tax attorneys were all once law students – meaning they can deal with any serious legal issues you may be facing. In summary, you can utilize a CPA to file taxes, but you should turn to a tax attorney if you are facing issues with the IRS.

Other Factors To Consider When It Comes To Tax Attorneys

There are a few other things to consider, when it comes to choosing a tax attorney. A CPA will likely only have a bachelor’s degree, whereas a tax attorny will have a JD – meaning they will be a master of laws, and will be much better equipped to deal with the IRS.

If you need someone who is very good at dealing with the IRS, enrolled agents have the highest status within the IRS system. In the United States, enrolled agents have many years of experience dealing with state tax issues, as well as federal tax problems.

Whether you’re facing an estate tax, have issues with back taxes, are facing a lien, a tax levy – or something even trickier – a tax attorney will be able to solve your problems. Additionally, they will have years of practice in dealing with the IRS directly.

The Bottom Line On Tax Attorneys

There you have it – everything you need to know about tax attorneys. When you need legal advice, or have tax issues – a tax attorney is your best option. A CPA will be great for preparing taxes, but once your tax return is filed – a tax attorney will be able to help you best.

They know all the particulars about the tax code, and know the best ways to fight against any federal tax penalties you may be facing. Tax attorneys have been in tax court before, and have passed the exam given by the American Bar Association in the state that they practice in.

A CPA, by contrast, will not have a Juris Doctor degree – meaning they are not nearly as well versed in the field of law. An accounting degree is quite different than a degree in law, so if you find yourself with troublesome tax matters, you’ll want to hire a tax attorney.
